1. Definitions
In these Terms & Conditions:
- "We," "us," "our," or "cresstwelals" refers to the company providing financial education services
- "You," "your," or "Participant" refers to individuals enrolled in or considering our programs
- "Programs" refers to our educational offerings including Budgeting & Cash Flow Mastery, Market Awareness & Investment Fundamentals, and Wealth Preservation & Succession Planning
- "Services" refers to the educational instruction, materials, and support we provide
- "Website" refers to our online presence at cresstwelals.info
2. Acceptance of Terms
By enrolling in any of our programs, using our website, or engaging with our services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.
You confirm that you are at least 18 years old and have the legal capacity to enter into binding agreements under Thai law.
3. Educational Services Description
3.1 Nature of Services
cresstwelals provides financial education programs designed to help participants develop knowledge and skills in personal finance management, investment understanding, and wealth planning. Our programs are educational in nature and do not constitute financial advice, investment recommendations, or professional financial planning services.
3.2 Program Delivery
Programs are delivered through a combination of live sessions (in-person or online), workbooks, exercises, and email support. Specific program details including duration, session frequency, and format are provided at the time of enrollment.
3.3 Availability
Programs are offered subject to availability and minimum enrollment requirements. We reserve the right to cancel or reschedule programs with reasonable notice if enrollment targets are not met.
4. Enrollment and Payment
4.1 Enrollment Process
Enrollment is completed when you submit the required information and payment is successfully processed. You will receive confirmation via email within 2 business days.
4.2 Pricing and Fees
Program fees are stated in Thai Baht (฿) and are current at the time of enrollment. All fees include applicable VAT as required by Thai law. Fees cover the program sessions, materials, and specified post-program support period.
4.3 Payment Terms
Payment is due in full at enrollment unless alternative arrangements have been agreed in writing. We accept bank transfers and credit cards. Payment plans may be available for certain programs upon request.
4.4 Refund Policy
You may cancel your enrollment and receive a full refund if:
- You cancel more than 14 days before the program start date
- We cancel the program
If you cancel within 14 days of the program start or after the program has begun, fees are non-refundable, though we may offer credit toward a future program at our discretion.
5. Participant Responsibilities
5.1 Attendance and Participation
Active participation enhances learning outcomes. While we understand occasional conflicts, regular attendance is expected. If you miss more than two sessions without prior notice, we may discontinue your enrollment without refund.
5.2 Conduct Standards
You agree to:
- Treat instructors and fellow participants with respect
- Maintain confidentiality of other participants' shared information
- Not record sessions without explicit written permission
- Not disrupt learning environment or engage in disrespectful behavior
We reserve the right to remove participants who violate these standards without refund.
5.3 Materials Use
Program materials are for your personal, non-commercial use only. You may not copy, distribute, sell, or publicly display materials without our written permission.
6. Intellectual Property
All content, materials, and intellectual property provided in our programs remain the property of cresstwelals. This includes workbooks, presentations, templates, exercises, and other educational materials. You receive a non-exclusive, non-transferable license to use these materials solely for your personal financial education.
7. Disclaimers
7.1 Educational Purpose Only
Our programs provide general financial education and are not tailored financial advice. We do not recommend specific investments, insurance products, or financial strategies for your individual situation. You should consult qualified professionals before making financial decisions.
7.2 No Guarantees
We cannot and do not make any promises about the financial outcomes you will achieve. Financial success depends on many factors beyond education, including market conditions, personal circumstances, and individual decisions.
7.3 Information Accuracy
While we strive to provide accurate, current information, financial regulations and market conditions change. We are not responsible for outcomes resulting from reliance on program content without independent verification.
7.4 Third-Party Content
Programs may reference third-party resources or examples. We do not endorse these third parties and are not responsible for their content, accuracy, or services.
8. Limitation of Liability
To the maximum extent permitted by Thai law:
- cresstwelals's total liability for any claim arising from your participation in our programs shall not exceed the fees you paid for that program
- We are not liable for indirect, consequential, or incidental damages including lost profits or opportunity costs
- We are not liable for financial losses resulting from decisions you make based on program content
- We are not responsible for technical issues, service interruptions, or third-party failures affecting program delivery
Nothing in these terms excludes liability that cannot be excluded under Thai law, including liability for fraud or willful misconduct.
9. Confidentiality
We treat personal financial information shared during programs with strict confidentiality as detailed in our Privacy Policy. However, we cannot control information you choose to share with fellow participants. Please exercise discretion.
10. Program Changes
We reserve the right to:
- Modify program content to reflect current best practices and regulations
- Change session schedules with reasonable notice to accommodate instructor availability or facility issues
- Substitute instructors when necessary while maintaining quality standards
- Move programs online if in-person delivery becomes impractical
Material changes that substantially affect your program experience will be communicated with options to withdraw for a full refund if you prefer not to continue.
11. Termination
11.1 By Participant
You may withdraw from a program subject to the refund policy in Section 4.4.
11.2 By cresstwelals
We may terminate your participation without refund if you:
- Violate these Terms & Conditions
- Engage in disruptive or disrespectful behavior
- Fail to pay agreed fees
- Misrepresent your identity or eligibility
12. Governing Law and Disputes
12.1 Governing Law
These Terms & Conditions are governed by the laws of Thailand. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.
12.2 Dispute Resolution
If a dispute arises, we encourage you to contact us first at [email protected] to attempt informal resolution. If informal resolution fails, disputes may be resolved through mediation before pursuing litigation.
13. General Provisions
13.1 Entire Agreement
These Terms & Conditions, together with our Privacy Policy and any program-specific agreements, constitute the entire agreement between you and cresstwelals regarding our services.
13.2 Severability
If any provision is found unenforceable, the remaining provisions remain in full effect.
13.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
13.4 Assignment
You may not transfer your enrollment or obligations to another person. We may assign our rights and obligations to a successor entity if our business is sold or transferred.
13.5 Notices
Notices to you will be sent to the email address you provided at enrollment. Notices to us should be sent to [email protected].
14. Changes to Terms
We may modify these Terms & Conditions from time to time. Changes will be posted on our website with the updated "Last Updated" date. For enrolled participants, material changes will not affect your current program enrollment unless required by law. Continued enrollment in future programs after changes constitute acceptance of updated terms.
